Florida Bankruptcy Court Records

The state of Florida preserves and maintains all court records. According to state law, these documents are part of the official records and available for public use with certain restrictions. Florida bankruptcy court records are part of these official documents and can be accessed for view, print or download from a number of sources. When an individual or company files for bankruptcy in Florida, all legal documents related to the bankruptcy case are updated into the bankruptcy record database and stored. It is the responsibility of the clerk of courts to keep the bankruptcy records in proper order.

Florida Bankruptcy Case Filing

Florida bankruptcy laws state that a person or business can file for bankruptcy if he or she is unable to repay all debts incurred. However, this is considered the last resort. Bankruptcy can be filed under a number of chapters. Under chapter 7, the debtor is required to surrender all assets to a court appointed trustee and his or her entire debt is forgiven. However there are exceptions to the assets that need to be surrendered. Under chapter 11, 12 and 13, a debtor is required to repay a particular portion of the debt within a certain period of time, as decided by the bankruptcy court.

Florida Bankruptcy Courts

The bankruptcy court records of Florida can be accessed from the various court locations. The bankruptcy courts of Florida are divided into the Northern District Florida Court, the Middle District Florida Court and the Southern District Florida Court. Each court has jurisdiction over a number of counties.

The Northern District Florida Court has jurisdiction over counties including Alachua, Calhoun, Franklin, Jefferson, Gilchrist, Gulf, Jackson, Lafayette, Leon, Liberty, Madison, Santa Rosa, Okaloosa, Taylor, and Washington.

Some of the counties under Middle District Florida Court are Baker, Brevard, Bradford, Charlotte, Citrus, Collier, Columbia, Duval, Flagler, Hamilton, Hendry, Hillsborough, Lake, Manatee, Marion, Nassau, Orange, Pinellas, Polk, Sarasota, St. John’s, and Volusia.

The list of counties within the jurisdiction of the Southern District Florida Court includes Broward, Highlands, Martin, Okeechobee, Palm Beach County, and St. Lucie.

Florida Bankruptcy Court Records Online Records

You can visit the court location or contact them over the telephone. However there is an easy way to locate Florida bankruptcy court records which is an online search. This option is available from PACER or Public Access to Court Electronic Records. All court records, including bankruptcy court records, are available from PACER. You can also send your queries, suggestions and comments to pacer@psc.uscourts.gov. 

PACER services are available to all, both in and outside United States. If you are a resident of the United States you can register as a user. This can be done by filling up the PACER online registration form available at https://pacer.psc.uscourts.gov/psco/cgi-bin/regform.pl.

After the submission of the form is completed, the user is given a login ID and a password. You can use the login id and the password to search the bankruptcy records of Florida. No registration fee is charged by PACER. However there is a nominal fee for the use of web-based search. For access to each page of PACER you need to pay $0.08.

You need to send the details of your credit card if you wish to register as a user with PACER services. The other fields that need to be filled in include personal details in the account information section, and password security information. If you are having problems with online registration or want to access PACER from outside the United States you can download the form from http://pacer.psc.uscourts.gov/documents/fax_reg_form.pdf and follow the instructions given on it.
