Atlanta Court Information

Atlanta Court serves the city of Atlanta, Georgia, and is a limited jurisdiction trial court. Atlanta municipal court was established by the General Assembly in 1913. However, it was the Charters of the City of Atlanta 1973 and 1996 that outlined the structure and functions of the present Atlanta Municipal Court. Modifications again occurred in July 2005 when the Atlanta Traffic Court was abolished. The administrative functions and operations of the Traffic Court merged with those of the Municipal Court of Atlanta. This step was taken for two reasons, to save on the city’s funds and to make the court system more organized and efficient.

Atlanta Municipal Court: Jurisdiction

The jurisdiction of Atlanta court in Georgia includes violations of traffic rules, city charter violations, city ordinances and such other violations, as outlined by the law of the state.

Preliminary hearings of all cases involving state offenses are taken up by the municipal court of Atlanta. A preliminary hearing is conducted, not to find out whether the charged individual is guilty or innocent, but to determine whether there is enough evidence to suggest a probable cause that indicates that the charged individual should be arrested or detained. If the judge finds the existence of a probable cause, the case is taken up by the State Court or Superior Court for trial.
